Terms & Conditions

Welcome to Vacation360 Club. By accessing our website or purchasing a membership, you agree to be bound by these Terms & Conditions.

1. DEFINITIONS

“Company” refers to Vacation360 Club.
“Member” refers to any individual who has purchased a membership.
“Membership” means the Right-to-Use (RTU) vacation plan offered by the Company.
“Resort” means any property owned, leased, or affiliated with Vacation360 Club.
“Usage Period” means the number of nights/days allocated annually to a Member.

2. MEMBERSHIP NATURE

2.1 The Membership is a Right-to-Use (RTU) product.
2.2 The Member does not own any property or real estate.
2.3 The Membership provides only holiday usage rights subject to availability and these Terms.
2.4 The Membership is valid for a fixed tenure (e.g., 5–25 years) as mentioned in the agreement.

3. MEMBERSHIP FEES

3.1 The Member agrees to pay:

  • One-time Membership Fee
  • Annual Maintenance Fee (AMF)

3.2 All payments are non-refundable, except where required by law or explicitly stated.
3.3 The Company reserves the right to:

  • Revise Maintenance Fees annually
  • Charge additional fees for upgrades, guest usage, or special services

4. BOOKING & AVAILABILITY

4.1 All bookings are subject to availability and prior reservation.
4.2 The Company does not guarantee availability during peak seasons or holidays.
4.3 Bookings must be made:

  • Through official website/app or customer support
  • Within the booking window defined by the Company

4.4 The Company reserves the right to:

  • Decline or reschedule bookings due to operational reasons

5. USAGE RULES

5.1 Membership usage is limited to the allocated number of nights per year.
5.2 Unused nights:

  • May expire if not used within the validity period
  • May be carried forward only if explicitly allowed

5.3 The Member must:

  • Follow resort rules and policies
  • Maintain proper conduct during stays

6. EXCHANGE & THIRD-PARTY SERVICES

6.1 The Company may offer exchange services through third-party partners such as RCI.
6.2 The Company is not responsible for:

  • Availability
  • Service quality
  • Fees charged by third-party providers

7. CANCELLATION & RESCHEDULING

7.1 Cancellation must be made within the defined cancellation window.
7.2 Late cancellations or no-shows may result in:

  • Deduction of usage nights
  • Additional charges

8. MEMBERSHIP TRANSFER & RESALE

8.1 Membership transfer is allowed only with prior written approval of the Company.
8.2 The Company may charge a transfer fee.
8.3 The Company does not guarantee resale or buy-back of Membership.

9. TERMINATION

9.1 The Company reserves the right to terminate Membership if:

  • Terms are violated
  • Payments are defaulted
  • Misconduct occurs

9.2 Upon termination:

  • No refund shall be provided
  • Usage rights shall cease immediately

10. LIMITATION OF LIABILITY

10.1 The Company shall not be liable for:

  • Loss, injury, or damage during stay
  • Travel disruptions
  • Natural disasters or force majeure events

10.2 The Member agrees to use facilities at their own risk.

11. FORCE MAJEURE

The Company shall not be responsible for failure or delay due to:

  • Natural disasters
  • Government restrictions
  • Pandemics
  • Strikes or unforeseen events

12. PRIVACY POLICY

12.1 The Company collects and processes personal data in accordance with applicable laws.
12.2 Member data will not be shared except:

  • With service providers
  • When required by law

13. AMENDMENTS

The Company reserves the right to modify these Terms at any time. Updated Terms will be published on the official platform.

14. GOVERNING LAW & JURISDICTION

14.1 These Terms shall be governed by the laws of India.
14.2 Any disputes shall be subject to the jurisdiction of courts in Alipurduar, West Bengal.

15. DISCLAIMERS

15.1 Membership is a holiday product, not an investment.
15.2 The Company does not guarantee financial returns or resale value.
15.3 Promotional offers are subject to specific terms and availability.

16. MEMBER RESPONSIBILITIES

The Member agrees to:

  • Provide accurate information
  • Make timely payments
  • Follow all policies and guidelines

17. INDEMNITY

The Member agrees to indemnify and hold harmless Vacation360 Club against:

  • Claims arising from misuse
  • Violation of Terms
  • Damage caused during stay
